The data protection guidelines related to all services available on the websites www.fonixdental.hu and www.fonixdental.com are continuously accessible on the referenced websites.

Smartcad Egészségügyi Kft., hereinafter referred to as the data controller, acknowledges the contents of this statement as binding, while reserving the right to modify it, provided that stakeholders are adequately informed of any changes in due time.

The data controller places great importance on respecting the right of its clients to informational self-determination. Personal data is handled confidentially, and all necessary measures are taken to ensure data security.

Principles of Data Processing

Personal data may only be processed if:
a) the data subject has given their consent (voluntary), or
b) it is required by law (or another legal regulation) or mandated by a local government regulation based on a public interest objective (mandatory).

Personal data may only be transferred or different data processing activities may only be linked if the data subject has consented or if the law permits it, and if the conditions of data processing are met for each individual personal data.

Personal data may only be processed for a specific purpose, to exercise a defined right, or to fulfill an obligation.

Only personal data that is essential for achieving the purpose of the data processing and suitable for attaining the objective may be processed, and only to the necessary extent and duration. Voluntary personal data may only be processed based on informed consent.

The data subject must be clearly, comprehensibly, and thoroughly informed of all facts related to the processing of their data, including but not limited to: the purpose and legal basis of data processing, the persons authorized to process and handle the data, the duration of data processing, and the entities that may access the data. The information must also cover the rights of the data subject and the available legal remedies.

The unrestricted use of a general and uniform personal identification mark is prohibited.

Processing of Personal Data

The collection and processing of personal data must be:
a) fair and lawful;
b) accurate, complete, and up to date when necessary;
c) stored in a manner that allows identification of the data subject only for the time necessary for the purpose of storage.

Data transfers to EEA (European Economic Area) states shall be treated as if they occurred within Hungary. Personal data may only be transferred to a data controller or data processor in a third country if the data subject has explicitly consented, or if permitted by law, and if an adequate level of protection for the transferred data is ensured during its processing in the third country.

Scope of Personal Data

The processing of personal data is based on voluntary consent.

We draw the attention of data providers to the fact that if they do not provide their own personal data, it is the obligation of the data provider to obtain the consent of the concerned individual.

Scope of Processed Data: username, password, surname and first name, email addresses, phone numbers, company name, date and time of registration.

Data Deletion Deadline: ten years from the last login, while for newsletter subscription consents, until the consent is withdrawn. Accounting records are retained for eight years in accordance with Section 169 (2) of Act C of 2000 on Accounting.

What Are Cookies and How Do We Manage Them?

Cookies are small data files (hereinafter referred to as cookies) that are placed on your computer through the use of the website, saved, and stored by your internet browser. Most commonly used internet browsers (Chrome, Firefox, etc.) accept and allow the downloading and use of cookies by default. Accepting cookies is not mandatory; however, Smartcad Eü. Kft. is not responsible for any website malfunctions due to the lack of cookie authorization.

The data controller deletes received emails, including the sender’s name, email address, and any voluntarily provided personal data, no later than five years after the case is resolved.

Storage and Security of Personal Data

Data Processing Related to Website Visits

Visiting the www.fonixdental.hu and www.fonixdental.com websites and viewing publicly available information does not require the submission of personal data. Smartcad Eü. Kft. automatically receives the following data from website visitors: the visitor’s IP address, visit time, viewed subpages, and content on the website.

These data are automatically transmitted to the Google Analytics service. Smartcad Eü. Kft. uses these data exclusively for website-related analysis and ensuring the secure operation of the website.

Storage and Security of Personal Data

The IT systems and other data storage locations used for data processing are located at the headquarters of the data controller.

Smartcad Eü. Kft. selects and operates its IT tools used for processing personal data in a way that ensures:

  • Availability: The data is accessible to authorized individuals.
  • Authenticity and Verification: The authenticity and verification of data processing are ensured.
  • Integrity: The integrity of the data is maintained.
  • Confidentiality: The data is protected against unauthorized access.

Smartcad Eü. Kft. takes technical, organizational, and procedural measures to ensure the security of data processing, providing an adequate level of protection corresponding to the risks associated with data processing.

During data processing, Smartcad Eü. Kft. ensures:

  • Confidentiality: Protects information so that only authorized persons have access.
  • Integrity: Maintains the accuracy and completeness of the information and its processing methods.
  • Availability: Ensures that authorized users can access the necessary information when required and that relevant tools are available.

The IT system and network of Smartcad Eü. Kft. are protected against computer-assisted fraud, espionage, sabotage, vandalism, fire, flood, computer viruses, hacking, and denial-of-service attacks. The operator ensures security through server-level and application-level protection measures.

Users are informed that electronic messages transmitted via the internet, regardless of protocol (email, web, FTP, etc.), are vulnerable to network threats that may lead to unfair activities, contract disputes, or information disclosure and modification. The service provider takes all reasonable precautions to protect against such threats. The systems are monitored to detect any security deviations and provide evidence in case of security incidents. This monitoring also allows for the assessment of the effectiveness of applied security measures.

Legal Remedies

The data subject may request information regarding the processing of their personal data, as well as request the correction or – except for legally mandated data processing – the deletion of their personal data in the manner specified at the time of data collection.

Upon request, the data controller provides information about the data it processes or that is processed by a contracted data processor, including the purpose, legal basis, and duration of the data processing, the name and address (registered office) of the data processor, and the activities related to data processing. Additionally, the data controller informs the data subject about who receives or has received the data and for what purpose. The data controller provides the requested information in writing in a comprehensible form as soon as possible, but no later than 30 days from the submission of the request. This information is free of charge if the data subject has not submitted a request for information on the same subject in the current year. Otherwise, Smartcad Healthcare Ltd. may charge a fee.

Smartcad Healthcare Ltd. deletes personal data if the processing is unlawful, the data subject requests deletion, the purpose of data processing ceases, or the legally mandated retention period has expired. Data may also be deleted upon the order of a court or the National Authority for Data Protection and Freedom of Information.

Smartcad Healthcare Ltd. notifies the data subject, as well as any parties to whom the data was previously transmitted for processing purposes, about any corrections or deletions. Notification may be omitted if it does not violate the legitimate interest of the data subject in relation to the data processing.

The data subject may object to the processing of their personal data if:
a) the processing (or transmission) of personal data is solely necessary for the enforcement of the data controller’s or the recipient’s rights or legitimate interests, unless data processing is mandated by law;
b) the personal data is used or transmitted for direct marketing, public opinion polling, or scientific research purposes;
c) the right to object is otherwise granted by law.

Smartcad Healthcare Ltd. will review the objection as soon as possible, but no later than 15 days from the submission of the request, and inform the data subject of the decision in writing. If the objection is justified, the data controller will suspend the data processing – including further data collection and transmission – and block the data. Additionally, the data controller will notify all parties who previously received the data about the objection and the actions taken in response, requiring them to also take necessary measures to enforce the right to object.

If the data subject disagrees with the decision made by the data controller, they may appeal to a court within 30 days of receiving the decision.

Smartcad Healthcare Ltd. may not delete the personal data if the processing is mandated by law. However, the data may not be transmitted to the recipient if the data controller agrees with the objection or if the court rules that the objection is justified.

If the data subject’s rights are violated, they may take legal action against the data controller. The court will handle the case as a priority.

Smartcad Healthcare Ltd. is liable for any damages caused by unlawful processing of personal data or breaches of technical data protection requirements. However, the data controller is exempt from liability if the damage was caused by an unavoidable external factor beyond its control.

The data controller is not liable for damage if it was caused by the data subject’s intentional or grossly negligent behavior.
